Before you begin setting up your account with Water-Snap.com (herein referred to as "we", "us", or "Water-Snap.com"), please read the following Terms of Use ("Term") carefully. If you ("you") agree to these Terms, and wish to use the Water-Snap.com service ("Service"), please click on the "Accept" button. This will constitute a binding agreement between you and Water-Snap.com. To decline acceptance, click the "Cancel" button. Note that any violation of these Terms may result in termination of our Service to you.

Water-Snap.com reserves the right to change these Terms from time to time. Please refer to this site periodically for any changes.

Your Submissions
Membership is available to anyone who registers all required information. Each Member is allowed to have only one Membership and the privileges associated with Membership. Water-Snap.com allows on registered Membership per legitimate electronic mail address1.
Membership is intended for personal use only and is non-transferable.

With regard to material you include in a public album, water-snap.com grants a non-exclusive, world-wide, royalty free license to modify, publish and reproduce said material for the purpose of displaying, distributing and promoting. Postings and other communications with Water-Snap.com are not private and may be published and edited at the discretion of Water-Snap.com unless specifically instructed otherwise.

Member Album Guidelines
The following is a non-exclusive list of actions and content that are NOT permitted on the Site:
Any use of copyrighted material without the expressed permission of the author or owner.

  1. Any material that encroaches the rights of others, including clear expressions of bigotry, racism, or hatred.
  2. Any material that is perceived by Water-Snap.com or members of the Water-Snap.com Community, as abusive, deceptive, profane, slanderous, offensive, or inappropriate, including pornography.
  3. Any use of material that contains viruses, corrupt files or other content which may compromise the Water-Snap.com or any user thereof.
  4. Any material that violates any laws or regulations of any governing body with jurisdiction over Water-Snap.com, its affiliates and users.
  5. Posting of promotion materials
  6. Any materials inconsistent with the values of the spirit of the Water-Snap.com Community.


Water-Snap.com may terminate Membership and any and all information, communications, Postings, or Albums at any time, without notice, for conduct that violates this Agreement or other policies or guidelines set out by Water-Snap.com elsewhere on the Site. Water-Snap.com may terminate Membership and delete any and all information, communications, Postings, or Albums for online conduct that Water-Snap.com believes is harmful to other Members, the business of Water-Snap.com, or other third-party information providers.

Copyrighted Material
You must ensure that your content transferred to and displayed at Water-Snap.com does NOT infringe any copyrights. All content provided by a user of this site is the sole responsibility of that user. If you think that any member infringes your copyrights, please contact the relevant member directly. If you can show sufficient evidence about the infringement, Water-Snap.com will remove such material within reasonable time.

Limitations of Liability and Warranty
The Member agrees that the use of the Site is entirely at the Member's own risk. The Site is provided on an "as is" basis without warranties of any kind, either expressed or implied. Furthermore, neither Water-Snap.com nor any third-party content provider makes any warranty with respect to any content, information, services, or products provided through or in conjunction with the Site.

The Member specifically agrees that Water-Snap.com or third-party content providers are not liable for any conduct by Members associated with the Site, including, but not limited to, Member Albums, Member Profiles, surveys, or message boards.

Water-Snap.com and third-party content providers make no guarantee of the accuracy, correctness, or completeness of any information on the Site and are not responsible for

  1. any errors or omissions arising from the use of such information;
  2. any failures, delays, or interruptions in the delivery of any content or services contained within the Site; or
  3. losses or damages arising from the use of the content or services provided by the Site.

    Indemnity
    A Member agrees to indemnify Water-Snap.com and any third-party information provider against any and all claims and expenses, including attorneys' fees, arising from the Member's use of the Site. This expressly includes:
  1. Member's responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights and
  2. any libelous or unlawful material contained within Member Albums, profiles, or Postings.


Amendment
Water-Snap.com may from time to time amend any of the terms and conditions of this Agreement by notifying you and such amendments shall come into effect immediately upon my/our deemed receipt of your notice. You acknowledge and agree that if you continued to use the service after such amendments as notified, you will be deemed as acceptance of such amendments in the terms and conditions.
Water-Snap.com reserve the right to amend any terms and conditions on all promotions and/or services without notice.

Merger Clause
This Agreement constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes any other agreement, proposals and communications, written or oral, between Water-Snap.com representatives and the Member. Water-Snap.com may amend this Agreement at any time with notice from Water-Snap.com to the Member as published on the Site.

The terms and conditions here are deemed as the whole arrangement binding between you and Water-Snap.com. Any other form of communication, either written or oral, would not affect the terms and conditions of the service provided.
